Here's the way things went down.
I was out with some friend in the evening, otherwise I would have had this island much earlier in the night. I spied the island first, noticed that the MH was down to one, and had been that way for awhile, so I dispatched a colo fleet without any cats (I would have sent a clearing fleet otherwise).
About 2 AM local time, my fleet landed. I was checking it regularly to make sure I didn't over colo. I checked my logs, and Dionysus' name was there, rather than unruled. Clearly, he landed about 5-10 minutes ahead of mine, and my MH stuck.
I build the house up to lvl 2, and went to bed. I got a few messages during the night, including this one:
The conversation continued from there, which was interesting because he doesn't think too highly of Morkin or DIGG, but that's expected because he's from [ruhk]. We settled amicably, and he got all his resources of the the farm. A DIGG member was also attacking the isle, but for once, did not send cats with his colo fleet, and everything was hunkey dorey. 24 hours later, Dionysus attacked my island with 100 LWS strong, and the dialogue began.
So you'll see from the get go that I tried to be fairly reasonable, but stuck to my guns. He was hostile, rude, harsh, and he lied on numerous occasions.
My position is this. He took the island before me, but didn't build the main house, and didn't even attempt to negotiate. I took it fairly, and there were no cats on board (not that it would have mattered), and built the MH. He attacked, catted it, and generally was a prick (pardon my language).
However, all that being said, it's just a game, and I'll stand by whatever the alliance decides upon. I must protest strongly to handing it over, however.

My patience and tempter are running low...I don't think I will be able to take more of this bullshit...I may release the beast in me any minute now...may jebus have mercy on all your IK souls... The isle is still in my control. I would have taken it back and stoner dropped it if he kept his fleets in the water.

Actually, I'm handling it. I got this from him where he rejects my beautiful offer of 5 cats and 35k gold.
Yeah, we play who takes it first keeps it. I've given over islands that I've overcolo'd. I'd be willing to pay Kae for his coloship and lose my first one. I stopped going after rulerless islands a while ago because everybody has different rules they play by, and I just stuck to killing people and taking islands. Now, when I got back in the fray, the first thing that happens, is I get overcolo'd.... I'm irritated, and would like to keep the island.

This is absurd, this guy has no claim to the isle at all. To be honest I don't quite know what to say now. Should I keep up the buttkissing? I don't think it'll do any good. It seems the only thing I could do now is start threatening him.

Tell him this is our policy, and if he doesn't agree with that it's not our problem. If he attempts to take the isle, then it will become his problem really fast, though. After all, we're in the better position as we already own the isle.

He seems to not be so confrontatonal, but he still wants the isle back... Any thoughts guys?

Interesting. I do see a lot of "pre-clears" out there in the game though from folks using tools. So, if this was just a farm that went rulerless, that's cool. I'm suspicious of lots of folks in the game right now from the stuff I see.
Anyway, back to the issue at hand. I still would like to pay for his colo and take the island back. :-)
It would certainly be a good foot forward after the CaptianCadaver issue we dealt with. He is still considered an enemy of Pantheon.

The way I see it, either--
a)Keep the isle and say tough titties b)Keep the isle and compensate .01-100% of a colo c)Give him the isle for the price of a colo ship
