I dont think its an exploit. There is a problem however, which was stumbled apon by Timbus. The "big" player doesnt receive a message if he iniciates an attack from another rulers planet. But even if he doesnt receive the dreaded transmission and his score is over 60% of the defender his fleet will still be intercepted and destroyed!
In spnouts case the bigger player that attacked him was most probably still within 60%. Spnout thought all along that the attacking fleet belonged to the planet owner from where it originated.

Thanks for explaining it, I thought it meant if you launch from a small planet the 60% rule doesn't take effect!

Key point here is "I tried to launch as their ships were approaching my planet" until there has been a battle the little player has not attacked you, as he could recall at any point until the first battle tick has taken place.
However, if you also got the message when launching after the first battle tick then it should be a different story.
From another thread "You are can safely attack any planet that is listed as white number on black in quadrant view."
