Ah... I love the dynamics of this server right now.
I sent two fleet last night to clear, and then colonize the island. About mid-morning, it was colonized by Dac910 (DIGG). My clearing fleet hit, knocked the house down to lvl 1, an hour later, my colony ship hit and was successful.

I of course did not do the clearing, but I fail to see how that is anything more than a moot point, as my ships were intended to indeed do the clearing. I'll compensate him for whatever he lost.

i was in a similar situation last week, i sent out 2 attacks and a colo fleet, my atacks landed but didnt clear a thing so i thought hmmmmm, looks like some1 did it, so i left my colo going. Litterally 10 mins before my colo got there come1 colo'd it and asked me to stop mine, lol. obviously i couldnt and i colo'd over him. Turned out i had to give the isle back as he cleared the isle and cost him over 600 LWS etc. thought it was fair due to his losses, but come on, i got there 10 mins after him, its not like i did it on purpose it was just purly a mistake on nobodys part

It seems like every available isle draws a dozen or more colo attempts these days.

he hardly cleared alot though imo.
No where near the amount close to losses like ruku mentioned.

Well he did colo the isle, then you came in with cats (even if it was meant for a clearing fleet), and over colonised... To me thats you in the wrong

I disagree.
You see an empty isle, send a colo-fleet. 5 minutes before you someone colonises it. You overcolo. Suddenly you are asked for compensation, even though you've done nothing wrong.
As there is no way to indicate that you're attacking an island for others to see (putting it on your profile doesn't count), there are no rights. The only right I'm prepared to accept is when taking a 1pt isles with a level 1 main house, and somebody attacks that isle with cats after you did. Then they acted improperly, as the general consensus is that you don't do that.
In the early days I had a conflict with War/Phoenix about a grover isle when he had quit. Gorbag (in charge of the account) had sent half the fleet away, and some War guy cleared the other half. I was right next to that isle, and I cleared the fleet that in the meantime had returned, and we both were unaware of this. We both did some clearing, so whose isle was it going to be? Better not to have silly rules at all. If you can't clear and take an isle before somebody else does, then don't try it.

In that particular case I'd say it be up to the parties involved to determine an amicable outcome. In most cases however I would, personally of course, return said isle if alot was lost clearing it (~100 LW+), and that I can prove they did indeed clear it (ie. my own spy showing the units beforehand). Currently I'm in a situation where I've lost ~400 LWS clearing an isle yet someone else looks to have lost around ~220 LWS in between my own clearing fleets which were 11 minutes apart. Admittedly its neither of our faults and naturally I'll be keeping the isle but had the other 'clearer' fully cleared the isle before me I'd simply return it.

Can an admin contact Rezin of DIGG, apparently he is the one handling the negotiations. My offer of 20 cats still stands. If he wants 'comp' for whatever he lost in clearing the isle, he can have that too. I have little intention of giving the isle up, however, as I colonized it fair and square.

my personal view on this sort of dispute is that if you take an isle without cats then its yours. once the main house is lvl 2 it belongs to whoever is in possesion at the time. obviously if someone has cleared huge defences to take it then i'll let them have it. But if someone sends cats, intentionally or not with a colo ship against an isle ive taken even if it doesnt take down the main house then i want the isle back. We all have our own little idea's of whats fair and whats not, as do most other players ( not counting the sheep who keep shouting ce-v1 at every chance, most of whom havent even read it ) thats why we have diplomats ;D

20 cats is more than fair but I would like to see more than an hour between the clearing fleet and the colo fleet. If he couldn't see the fleet coming and you did not warn him, then you can't expect a person to be online 24 hours straight watching thier island. You may as well send the cats with the colo at that point. A diplomat should handle it though, not an admin.

An update on this. I was talking with Dac last night, and appealing to his humanitarian side. It has been forwarded to the diplomats at this point, and I was contacted this morning.
I've continued to offer 20 cats in payment for the isle. Also making the point that it was taken in an innocent, but unfortunate manner, but that frankly, I need the isle more than he does.
If any diplomat/admin want to jump in on this, I'd love the help.
